The United States court summoned, on Monday (7), Minister Alexandre de Moraes of the Supreme Court (STF) to respond to an action filed by the companies Trump Media-which belongs to the US President Donald Trump-and the Rumble video platform.
Companies in determining the suspension of accounts on social networks, and ask their decisions to be valid in the US territory.
According to the subpoena, Moraes has 21 days to present a formal response or make a motion contesting the process. If not, the Court can issue a decision to the default, automatically receiving companies’ requests.

In the petition, companies argue that the Brazilian minister violated the 1st amendment of the US Constitution, which protects freedom of expression. They claim that their decisions prevent the view, on American soil, of legitimate political content produced by suspended users in Brazil-among them, journalist Allan dos Santos, linked to the far right.
The authors ask US court to declare the orders of unenforceable Moraes in the United States, stating that the minister’s performance compromises protected constitutional rights in the country.
The Rumble Case
The legal clash between Moraes and the Rumble platform intensified after the one, determined in February this year. The Supreme Court required the company to block Allan dos Santos profiles, cease financial transfers to him and present a legal representative with powers in the country, which was not fulfilled, according to the Court.

After breaking the court order, Rumble had its operation temporarily interrupted in Brazil. The platform claimed that its lawyers had no legal authority to respond as representatives in the country and later resigned.
Given this, the company filed the American court, classifying the Supreme Court’s requirements as censorship and requesting legal protection based on US laws.
Transnational conflict
The case deepens the tension between Brazilian authorities and foreign digital platforms, while inserting the Brazilian judiciary in a political bias dispute in the United States.

The action reinforces the persecution narrative defended by allies of Jair Bolsonaro, including Donald Trump himself, which recently.
While the Supreme Court keeps focusing on the dissemination of misinformation and attacks on democratic institutions in Brazil, the articulation of conservative platforms is growing to try to block these measures based on American legislation.
