Chamber approves project urgent regime that cuts tax benefits by 10%

The House of Representatives approved on Tuesday, 8, in a symbolic vote, the emergency regime for the process of the bill that proposes a linear cut of at least 10% in federal tax benefits of a tax, financial and credits in the period 2025 and 2026. The agreement for approval left the leaders meeting held on Tuesday morning, 8.

Authored by Deputy Mauro Benevides (PDT-CE), the text foresees a gradual reduction, with at least 5% this year and at least 5% next year. The percentages may be differentiated by the economic sector. Moreover, according to the PL, the granting of new benefits of the same nature is prohibited, as well as the extension of existing existing ones, unless otherwise reduced by other benefits of the same nature and equivalent.

The approval occurs the week following the vote on the emergency regime for a project by Senator Esperidião Amin (PP-SC) on rules for tax exemptions. Already approved in the Senate, the text changes the Fiscal Responsibility Law to provide that any legislative proposition that deals with granting, expansion or renewal of any incentive or benefit of a tax nature that implies revenue revenue for legal entity will have a period of validity not exceeding five years, with permission for periodic renewal.

There was a desire for government leadership in the House of using Amin’s project as an umbrella to at least part of the house discussions about tax exemptions, in the wake of discussion of alternative measures to the increase in the tax on financial operations (IOF). One of the initial ideas was to appeal to the project texts considered “stronger”, including Benevides. However, the deputy was able to collect the necessary signatures to request the urgency of his project.

There is a chain in the House that argues that the House vote, even before the recess, the Amin project. One of the ventilated ideas would even be that Mauro Benevides was the rapporteur of the text in plenary. Deputies who advocate such strategy consider that it would be possible to approve Amin’s text as a first basis of the House discussion of tax exemptions and from there advances the cut of benefits. However, there is still no agreement on this possibility.
