A CCJ (Constitution and Justice Commission) and Chamber of Deputies intends to analyze, this Tuesday (8), the PEC PEC PECauthored by the federal government.

Throughout this week, opposition parliamentarians have been working to postpone this analysis and their intention is that a request for a view would be submitted, which would delay the appreciation in at least one session.

Prepared by the Ministry of Justice, the proposal attributes to the Union the responsibility of formulating the National Public Security Policy, coordinating the Penitentiary System, in addition to elaborating a national plan for the area.

The measure, however,.

Processing

Initially, the text was the target of much criticism from governors and mayors around Brazil, who accused the executive of wanting to assume responsibilities without paying the cost. Therefore, the federal government changed some excerpts before delivering the proposal to the House leaders.

It took at least six months of negotiations with state leaders, as well as several changes in the first version of the text.

With the changes, the, with the exception of the governor of Goiás, Ronaldo Caiado (Union).

The basis of the proposal is the constitutionalization of SUSP (Unified Public Security System), as well as instruments that allow and facilitate the exchange of information between municipalities, states and union and the creation of the Federal Road Police, which replaces the PRF (Federal Highway Police)which will allow ostensive policing on highways, railways and waterways.

Even with the changes made, the argument of opposition parliamentarians remains that PEC is “unconstitutional.” Deputy Caroline de Toni (PL-SC), who is part of the CCJ, told CNN .

“I understand that it is unconstitutional, because it hurts the autonomy of states and governors, which is even stone clause,” he said.

Mendonça Filho met with the president of the Chamber of Deputies, Hugo Motta (Republicans-PB), on Tuesday to talk about the matter.

Hugo has positioned it earlier, on the date the government delivered the text with the modifications. According to him, “there is a convergence and unanimity about the urgency of treating this theme.”

“It is important to say that all parties were represented here. Opposition, allied base and everyone agreed with the urgency of the House of Representatives to respond to this situation of public security,” he said at the time.

He even said publicly that he would “do everything” for the approval of the text and even promised his vote until the end of June, which did not happen.

In the view of the Minister of Justice, Ricardo Lewandowski, who headed the project, “both the Executive and Legislative Power owe to Brazilian society the discussion of this great theme, which is the theme related to public safety, and that alongside education and health, concern the ordinary citizen.”

What happens next?

The processing of the proposal begins precisely in the Constitution and Justice Commission of the Chamber. From then on, it will be sent to a second commission, which will be created especially for this debate, to only be sent to the plenary.

For its approval, it is necessary that at least three fifths of deputies approve the text in two voting shifts. If this happens, the text is directed to the Federal Senate.

“Historical act”

By officializing the delivery of the proposal to the National Congress, the President of the Republic, Luiz Inácio Lula da Silva (PT), and said that the text will prevent Brazilians from continuing “walking scared”.

“[O governo federal] It does not want to interfere with the responsibility and autonomy of each state in the issue of public safety, what we want to say to the Brazilian people that the federal government has definitely assumed the responsibility of making themselves available to states so that we can take care of security and not allow the Brazilian people to continue to be scared, “he said.
