The Rapporteur of Security PEC na CCJ (Constitution and Justice Commission)deputy Mendonça Filho (Union-PE), excluded from the proposal the article that gave to the Unity exclusive competence to legislate on public safety, social defense e prison system.
According to the parliamentarian, the government text hurts the federative pact by compromising the autonomy of states and municipalities and grants unconstitutional powers to the Union. Currently, the competence to legislate on the topics is shared with state and municipal governments.
According to the deputy, although it has caveats to the content of the proposal, the CCJ analyzes only the constitutionality and admissibility of the text, not the merit. Therefore, this was the only modification made in relation to the original text.
The opinion will be presented on Wednesday (9) to the commission. There is still a possibility of a request for a view from deputies, which may postpone the vote in at least one week. That is, there is no guarantee that the report will be voted on Wednesday.
The rapporteur said he met on Tuesday with the mayor, Hugo Motta, and with the Minister of Justice, Ricardo Lewandowski, to discuss the text.
If approved by the CCJ, the proposal will go to a special commission and then to the House plenary, where it may undergo new changes.
According to the deputy, another sensitive point of PEC, which can still be adjusted until Wednesday, deals with the attributions of PRF (Federal Highway Police).
The text prevents the PRF from performing typical judicial police functions, such as the investigation of crimes, attributing this responsibility exclusively to the PF (Federal Police) and to the civil police. In practice, the measure expands the power of the PF.
The proposal authorizes the Federal Police to investigate infractions against the political and social order (including environmental crimes), as well as criminal and militia organizations with interstate or international action.

Part of the deputies argues that the PF would not have enough contingent to conduct interstate investigations, which could lead federal agents to “choose” which cases investigate. With this, PF could “benefit” or “harm” politicians or entrepreneurs and end up becoming a “political police.”
On the other hand, the government considers that the proposal aims to reduce the attributions of the PF and “shield” the congressmen of investigations. The PF currently conducts investigations into misuse of parliamentary amendments involving politicians.
