The court upheld in the second instance of the (working cause party), for associating the federal deputy (Union-SP) in case involving the government’s (PT) help with the UN of refugees.
The decision, of the 2nd Civil Class of the Court of Justice of the Federal District and the Territories, is this Thursday (10). The rapporteur of the case, Judge Alvaro Ciarlini, denied PCO’s appeal against the conviction in the first instance. He was accompanied by Judges Renato Rodovalho Scussel and Fernando Antonio Tavernad Lima.
In February 2024, the federal deputy filed a lawsuit to oblige the Lula government to interrupt the. Pimenta, in reaction, posted a video criticizing Kataguiri. “Then we say that this is Nazism. Dude says: how so Nazism? Yeah, Nazism was that: it killed the people of hunger, put it in the concentration camp and killed hungry.”
In the appeal, Pimenta stated that Kataguiri’s action had lost object, as the video had been removed from the internet. The rapporteur, however, stated that the deputy filed a lawsuit to obtain the conviction of the president of PCO to pay compensation for deadly damages for alleged practice of unlawful act.
“Thus, despite the removal of the contested content from the worldwide computer network, the supervening loss of interest did not occur in the case,” writes the judge.
Pimenta will have to pay $ 10,000 to Kataguiri.
