The president’s government (PT) responded to the letter sent by the United States Department of Justice in May stating that decisions of Brazilian courts only apply within the country.

The answer was given about two weeks ago, before the US President, publicly left the former president, claiming that he is persecuted.

A Sheet He had access to excerpts from the Ministry sent by the Directorate for the Recovery of Assets and International Legal Cooperation of the portfolio.

The document does not enter into the merits of any specific case, such as orders from the Minister, the Supreme Court, who aim at the Rumble Video Platform, but touches on one of the US -sent notes.

The letter sent by the US Department of Justice to Moraes, with a copy to the Ministry of Justice, states that the minister’s decisions do not apply to companies and citizens in the US because they are extraterritorial.

In order for them to enforce, the foreign agency said, the magistrate would have to have filed a lawsuit in a US court or have appealed to legal channels.

The letter from the Ministry of Justice points out that decisions taken by cuts in Brazil are only directed to companies or citizens who are in the national territory.

“Consequently, the legal validity and the applicability of such orders are limited to national domain and not presumed to extend beyond it,” he says.

“Judicial decisions given by Brazilian courts are intended to operate strictly within the territorial jurisdiction of the Federative Republic of Brazil. These determinations should not be interpreted as exerting extraterritorial effect nor are they intended to impose obligations on entities or individuals beyond the limits of Brazilian sovereignty.”

In the letter, the Ministry of Justice also says it wants to maintain international cooperation with the US and reinforce the mutual legal mechanism. Minister Moraes decided not to respond to the US government.

The government’s decision to respond came to the assessment of making a gesture by dialogue channel, but without giving in any accusations of Americans. Even without mentioning the name of Moraes or Rumble, the intention is to detail the Brazilian judicial process and clarify that there was no extraterritoriality.

A person close to Trump said the answer was well regarded by people linked to the process, although it was not read as sufficient to end the American’s allies offensive against Moraes. Only a retreat in the minister’s decisions regarding the platforms would generate this effect, they say.

Neither the Supreme Court nor the Ministry of Justice wanted to comment on the document.

When he sent the letter in May, the Justice Department stated that the document was motivated by information provided by Rumble.

The company reported to the department that it was the target of four lawsuits in February, in which Moraes ordered an individual’s blockade of accounts (who would be the pocketist Allan dos Santos) and to suspend the transfer of funds to him.

“These alleged guidelines are issued under threat of monetary penalties and other sanctions,” the document says.

Rumble went to court asking the court to determine the payment of “compensatory damages” to companies, with the magistrate’s civil liability. In the document, lawyers call Moraes decisions “gag orders” and accuse him of censorship.

requests the Court to declare as unenforceable in Moraes’ orders against the platform. It also asks the court to prevent the minister from determining other companies, such as Apple, to remove it at its platform application stores.
