Minister André Mendonça of the Federal Supreme Court (STF) will be the rapporteur of the action presented by the defense of Filipe Martins, former special advisor of Jair Bolsonaro (PL), who seeks to suspend the progress of the 2022 coup plot survey.
The petition questions the conduct of Minister Alexandre de Moraes, rapporteur of the main inquiry, and claims that Martins had his rights violated during the process, such as the right to freedom of expression, broad defense and contradictory.

“Even if there was never a risk of any escape, Filipe Martins was subjected to hateful precautions and violating freedom of expression,” the defense wrote.
The petition also states that the conduct of hearings violated the right to production of evidence that could demonstrate the innocence of the accused, and maintains that Mauro Cid’s testimony improperly attributed a centrality to Martins in the coup plan.

Out of the rapporteur of Moraes
André Mendonça’s choice as a rapporteur occurred because the action targets minister Alexandre de Moraes. Therefore, Moraes was legally removed from the conduct of this specific process.
Mendonça’s rapporteur was published on a certificate last Friday (11) and represents the first defense presented by one of the defendants directly against the decisions of Moraes.
Martins’s defense publicly celebrated the appointment of the new rapporteur. On social networks, the lawyer stated that the choice represents a “new stage” in the process of contesting STF measures in the event of the coup attempt.

“Core 2” of the plot
Filipe Martins was arrested preventively in February, by order of Moraes, under Operation Tempus Veritatis, which investigates the organization and articulation of a plan to prevent Lula’s possession and keep Bolsonaro in power. He is appointed as a member of the “core 2” of the coup plot, linked to the attempt to obtain military support and the spread of misinformation.
Martins denies all accusations and states that it did not integrate the decision -making core of the conspiracy. According to his defense, he only accompanied the presidential entourage abroad at the end of 2022, which, according to them, would not configure any unlawful conduct.
