In the document sent to the Florida Court, the companies complain that the decision was sent by email and would be irregular. The document aims to inform the judge responsible for the action and then add new requests.
In the petition, companies say that Constantine is an American citizen and that the platform could not send their data under penalty of infringing his own laws. They also claim that Moraes’s decision is obsolete, because the commentator’s profile would be inactive in Rumble since December 2023 and because the company’s content has been blocked in Brazil since February.
“A [plataforma] Rumble does not intend to comply with the defendant’s requirements because they are invalid and unenforceable, “they say.
Constantino, target of the decision, was the target of the fake news inquiry and had his passport canceled at the beginning of 2023 by order of Moraes. In 2024, he obtained American citizenship. Rumble claims that Moraes’s request to block the account would be a pretext.
“The order of July 11 was issued just two days after President Donald J. Trump send a formal letter to President Lula da Silva expressing concern about the treatment of Brazil to US technology companies,” they say at another time of the petition.
The lawyers of social networks also state that Moraes’s decisions are opposed to a letter sent by the US Department of Justice to the minister in which the agency says that in order to use in another country, orders need to go through a different rite from sending the email.
“The order was not delivered through any legal treaty mechanism and seems to have been issued without notification to the US government,” they say.
Rumble and Truth Social questioned Moraes’ orders in Florida in February.
Then, in May, they asked the magistrate’s civil liability, and that the court determines the payment of “compensatory damages” to companies. In the document, lawyers call Moraes decisions “gag orders” and accuse him of censorship.
In February, Rumble already asked the Court to declare as unenforceable the orders of Moraes asking for the removal of Allan dos Santos’s profile from the platform. In the evaluation of Rumble’s lawyers, the order would not be restricted to the profile of youtuber in Brazil, but it would be worth around the world, which, for companies, makes it illegal.
Rumble and, as a result, in February (already targeted by the US action), the STF minister sent throughout the national territory. Since then, it has been the target of a daily fine of $ 50,000.
In Friday’s decision, however, Moraes makes it clear that the blockade refers to “the entire national territory”.
Moraes’s decisions aiming Big Techs are part of Trump’s justification to apply 50% rates on products imported to Brazil. The attitude of the US President was the result of media companies and licensed deputy Eduardo Bolsonaro (-SP).
Behind the scenes, people linked to the company saw the Order of Moraes as a provocation.
They also say that it contradicts the spirit of, in which the government says it wants to maintain cooperation in international law with the US and that justice decisions apply to Brazil.
The American president and pockets bet on declines of orders by the Brazilian government and judiciary, although members of both have noted that they will not give in to pressure. Moraes’s new decision is expected to cause new developments in the week.
In the letter addressed to President Lula, Trump quotes “hundreds of orders” that would represent censorship of Americans’ freedom of expression.
The republican’s decision was also driven by the recent, which increases the accountability of social networks.
In the words of Rumble’s rumble lawyer, Martin de Luca, this Friday’s order would be “an irresponsible escalation that exposes to Brazil to an even more serious diplomatic crisis.”
