In the last stage before the sentence, the Federal Prosecutor’s Office filed the final allegations in the case against the ‘crucial core’ of the coup plot
A asked this Monday (14) to The conviction of former President Jair Bolsonaro and seven other defendants of the coup plot. The demonstration was sent to Minister Alexandre de Moraes, around 11:45 pm, and is part of the final allegations, the last phase before the judgment of the accused, which should take place in September this year.
In the document, which has 517 pages, the Attorney General, argues that and the other defendants are convicted of crimes of armed criminal organization, attempted violent abolition of the Democratic Rule of Law, coup, damage qualified by violence and serious threat and deterioration of listed assets. The maximum penalties for crimes are 30 years in prison.
In addition to Bolsonaro, the PGR requested the conviction of the following defendants:
- Walter Braga Netto, Army General, former Minister and Vice of Bolsonaro on the 2022 election plate;
- General Augusto Heleno, former Minister of the Institutional Security Office;
- Alexandre Ramagem, former director of the Brazilian Intelligence Agency-ABIN;
- Anderson Torres, former Justice Minister and former Security Secretary of the Federal District;
- Almir Garnier, former Navy Commander;
- Paulo Sérgio Nogueira, Army General and former Defense Minister;
- Mauro Cid, whistleblower and former joint of Bolsonaro’s orders.
In case of conviction, ICD should have the penalty suspended due to the award -winning plea agreement signed with the Federal Police (PF) during investigations.
Bolsonaro
At the demonstration, the attorney general described the role of former President Jair Bolsonaro in the coup plot. According to him, Bolsonaro appears as leader of the criminal organization and was the “main articulator and greatest beneficiary” of actions to try to implement a coup in the country in 2022. In Gonet’s words, the former president instrumentalized the state apparatus and operated in “persistent scheme” of attack on public institutions and the succession process after the outcome of the presidential elections.
“With the support of high -ranking government members and the Armed Forces strategic sectors, it systematically mobilized state agents, resources and competences, in default of the public interest, to propagate untrue narratives, provoke social instability and defend authoritarian measures,” said the prosecutor.
Next Steps
With the presentation of the PGR demonstration, it begins to count a period of 15 days for the defense of Mauro Cid, whistleblower in the investigation, to present his final allegations to the Supreme Court. Then it will be the turn of the defendants’ defenses to submit their allegations within the same period. After receiving all demonstrations, the trial date will be set by the first class of the Court. Behind the scenes of the Supreme Court, the trial is expected to be held in September this year.
