The Minister of the Federal Supreme Court (STF) determined that the defense of the former deputy manifests himself urgently about the breach of house arrest rules and electronic monitoring, under penalty of immediate decree of the arrest.

The decision was published after the Rio de Janeiro Penitentiary Administration Secretariat informs that the former parliamentarian violated for three days in July, in July, the area of inclusion established as part of the precautionary measures, which indicates possible disrespect for the conditions imposed by the court.

“The lawyers constituted by the defendant João Francisco Inácio Brazil are summoned to provide clarification on the breach of house arrest, plus the imposed precautionary measures, under penalty of immediate decree of the arrest,” Moraes wrote in the decision. In addition to the electronic anklet, Chiquinho Brazão is prohibited from using social networks, giving interviews without judicial authorization and maintaining contact with others investigated in the case that investigates the murder of councilwoman Marielle Franco and driver Anderson Gomes.

Remember the case

Chiquinho Brazão was arrested in March 2023, along with his brother Domingos Brazão, advisor to the Rio de Janeiro State Court of Auditors (TCE-RJ), after being pointed out by the Attorney General’s Office (PGR) as the mandants of the parliamentarian’s murder. The accusation came from a denunciation of former military police officer Ronnie Lessa, who confessed to being the crime executor in March 2018.

Despite the arrests, Chiquinho Brazão continues with an office in the House of Representatives, with dozens of active advisers and receiving salary normally, while his revocation process remains stopped at the House Ethics Commission. The same applies to counselor Domingos Brazão, who also maintains the position in the TCE-RJ.

Another accused in the case, the former chief of the Rio de Janeiro Civil Police, delegate Rivaldo Barbosa, has been pre-tried for over a year. He was denounced for planning and ordering the murder of the councilwoman. Barbosa recently requested the revocation of his arrest, but the PGR defended the maintenance of the precautionary measure. The Marielle case, which completes more than six years without definitive judgment, remains one of the most emblematic and charged by Brazilian society, involving serious accusations against prominent figures of politics and public institutions in Rio de Janeiro.
