Law prohibits sales of “bags” to delivery delivery in RJ

The state of Rio de Janeiro sanctioned the Lei 10.885/25which establishes new rules for transport scholarships of delivery delivery. The measure, published in the Official Gazette last Tuesday (15), determines that the scholarships with companies logos are numbered individually and provided free by platforms.

The main objective of the new legislation is to curb the action of false deliveries and increase the public safetyfacilitating the tracking of professionals.

Authored by Deputy Alexandre Knoploch (PL), the new legislation vetoes the commercialization of Delivery bags with companies logos by unauthorized third parties. The standard specifies that only delivery platforms can provide equipment at no cost to the worker. Generic scholarships, which do not have brands identification, such as black ones, will continue with the free sale.

The law determines that each scholarship is linked to the delivery registration on the platform, although it allows the professional to have registration in more than one application. As a result, registered workers will be able to use the transport scholarship provided by a company to make deliveries of a competing application, ensuring flexibility in the execution of the work.

According to the author of the proposal, the measure is a response to the increase in crimes committed by individuals who pass through delivery. “Criminals have bought these scholarships and have used these scholarships to commit crimes. In turn, residents who call the application, or those who see the delivery man pass, believe he is the delivery man,” explained Knoploch.

Other determinations and sanctions provided for by law

In addition to the numbering and free supply, the Delivery platforms must maintain an updated record of all scholarships delivered to each employee. The equipment should have appropriate thermal insulation and sealing for the transportation of food and other products, and should be replaced by companies in case of wear or damage.

Failure to comply with the new rules can lead to severe sanctions to application companies. The legislation provides since temporary suspension of the service until the application of a R $ 5,000 fine for each bag that is provided in disagreement with the established determinations.

Companies will have a period of up to 90 days from the date of publication to suit the new requirements. The inspection will be in charge of the competent bodies of the Executive Power, which will guarantee the correct application of the law throughout the state of Rio de Janeiro.
