Amid a new clash between the powers, the Minister of the Federal Supreme Court () authorized the continuity of the government decree that raises the tax rate tax rate (). The decision was made even after the National Congress overthrew the measure in voting in the plenary. The minister’s decision generated a strong opposition reaction, which accuses the Supreme Court of disrespecting the sovereignty of the Legislature.
For the deputy opposition leader, Deputy Sanderson (PL-RS), the decision hurts the autonomy of Parliament: “Minister Alexandre de Moraes has the increase in IOF reestablish and, therefore, commits another illegal interference in the Legislature. Those who commit a crime of responsibility must be punished with impeachment! Either the National Congress plays its constitutional role or no reason to exist!”
In the same line, Deputy Rodrigo Valadares (Union) classified the decision as an explicit case of judicial activism: “It is a clear example of improper interference. The STF cannot legislate by injunction. Moraes has exceeded the limits and is creating an environment of legal and fiscal insecurity.”
The deputy (PL-SP) also reacted firmly: “Congress was clear in rejecting the increase in IOF. The decision of the Supreme Court is a disrespect to popular will, expressed through the elected representatives. We are seeing the advance of a togate authoritarianism.”
Deputy Captain Alberto Neto (PL-AM) warned of the institutional risks involved: “To ignore Congress is to ignore the will of the people. This decision is arbitrary, abusive and creates a dangerous precedent for democracy. We cannot accept this constant interference of the judiciary.”
Finally, Deputy Rodolfo Nogueira (PL-MS) stated that the Supreme Court acts as a government pull, contrary to the Constitution: “It is another chapter of the judiciary’s submission to the executive. The people are suffocated with taxes, and yet Moraes decide to maintain the increase of IOF. Brazil is tired of this authoritarianism that ignores the voice of the congress and the pain of the people.”
