Moraes submits a decision against Bolsonaro to the Plenary of the First Class

Minister Alexandre de Moraes, of the Supreme Court (STF), submitted the decision that determines that former President Jair Bolsonaro (PL) use anklet and imposes other precautions on the virtual plenary of the first class. This Friday (18), the Federal Police served searches and seizure at Bolsonaro’s house.

According to the decision, the president of the First Class, Cristiano Zanin, will be requested immediately of a virtual plenary session to evaluate the minister’s decision.

The virtual plenary will be open at noon this Friday.

In this case, the recess of the judiciary will not be counted, since the process originated from an investigation where there is a defendant arrested, referring to Marcelo Câmara.

The first class is formed by Cristiano Zanin (president), Carmen Lúcia, Luiz Fux, Alexandre de Moraes (rapporteur) and Flávio Dino.

According to PF investigations, Bolsonaro, and his son, licensed deputy Eduardo Bolsonaro (PL-SP), have been acting, over the past few months, with government authorities in the United States of America, in order to obtain the imposition of sanctions against public agents of the Brazilian State, due to alleged persecution in criminal action that Bolsonaro is the Supreme.

In the analysis of the PF’s request, Moraes said that there is evidence that both Bolsonaro and Eduardo have committed “unlawful acts that can configure, in theory, the crimes Art. 344 of the Penal Code (coercion in the course of the process), art. 2, §1 of Law 12.850/13 (obstruction of criminal infraction investigation involving criminal organization) of the Democratic Rule of Law). ”

Precautionary measures against Bolsonaro

Moraes’s decision states that Bolsonaro should comply with home collection between 19h and 6am from Monday to Friday and full time on weekends and holiday.

The former president will be monitored by an electronic anklet and will not be able to keep in touch with ambassadors, foreign authorities, nor approach embassies and consulate headquarters.

The measures were requested by the Federal Police and had a favorable opinion from the PGR (Attorney General’s Office).

By note, the former president’s defense stated that “he received with surprise and indignation the imposition of severe precautionary measures against him, which until the present moment has always complied with all determinations of the judiciary.”
