Decisions can make Tarcisio’s plan unfeasible to start the program in the second half of this year in 100 schools in the state network of São Paulo.
Apeoesp claimed, in its petition, that the notice violates the principles of impersonality and morality. The Union also argues that the hiring of people from the same segment, in this case, reserve police officers, disrespects the plurality required in the school environment.
Given these arguments, the judge had the effects of the notice suspend until the definitive judgment of the action and ordered Tarcisio management to present his information within 30 days.
PSoists, on the other hand, state in popular action that hiring is illegal, besides unconstitutional, because there is no budget forecast for the implementation of civic-military schools this year. According to them, the hiring and dismissal without public tender and through personal interviews hurts the principle of impersonality.
The judge understood that the hiring of the police, without budgetary forecasting and through an informal selection process, violates constitutional rules. Larissa also exposed the risk of changes in the routine of units that convert to civic-military schools during the school year.
“The danger of damage is present in view of the proximity of the date expected to start hiring, with concrete risk of consolidating public expense and potentially invalid administrative structure,” the judge wrote in the decision.
In a statement, Seduc stated that the suspension of the announcement may harm students who opted for the civic-military model.
“The portfolio reiterates that the implementation of the model respects the right of choice of families and the school community, which have manifested favorably during the adhesion process,” the government said. “The purpose of the initiative is to expand school management options, ensuring a safe and quality learning environment.”
The police selection notice provides. This amount will even be added to what the police already receive from retirement.
In actions, the union and parliamentarians say that most public school teachers today – 52% of them under temporary contract regime – receives $ 5,300 for a 40 -hour journey.
According to Tarcisio management, police officers should act as monitors in ethics, citizenship and civic activities. They will also supervise compliance with specific rules for these units, such as the obligation to chant civic hymns and the correct use of uniforms by students.
