The Minister of the Supreme Court (STF) decided to maintain the hacker’s pre -trial detention, sentenced to 8 years and 3 months imprisonment for invading Brazilian justice systems. Both were convicted of crimes of invasion of computer device and ideological falsehood after the insertion of fraudulent documents in the National Council of Justice (CNJ) systems – among them, a false arrest warrant against Moraes himself.
The decision of the minister, published on Saturday (19), states that the grounds that justified the pre-trial detention, decreed in August 2023, remain valid. Moraes highlights the “social danger and the concrete severity of the conduct attributed to the defendant” as sufficient reason to keep him in prison. In another stretch, it points out that Delgatti’s freedom is a risk to public order and the application of criminal law. The demonstration is a response to the defense request, which requested the progression to the semi -open regime. Delgatti has been arrested in Tremembé (SP) prison for two years. As the penalty is 8 years and 3 months, the lawyers argue that he has already fulfilled 20% of the time, which would pave the way for progression.
The hacker’s defense maintains that he was “deluded” by Zambelli’s promises, pointed out as the “intellectual mentor” of the plan. Already the lawyers of the deputy state that Delgatti is a “compulsive and mythomaniac liar” and deny any relationship between the two the defense even asked for an online caress. In addition to the prison sentence, Delgatti and Zambelli were also ordered to pay $ 2 million for collective material and moral damages.
Zambelli remains at large in Italy. Days after the conviction, the deputy asked for the House medical license for treatment in the United States, where she participated in a live announcing that she would not return to Brazil. Faced with the escape, Moraes ordered his pre -trial detention and the inclusion of the parliamentarian’s name in Interpol’s Red Diffusion list, considering that she tries to shy away from serving the sentence.
