The Trump administration will be a change to the law to grant the right to possession of arms to thousands of Americans who are currently legally prevented from having them. But there are exceptions.
On Friday, the Justice Department (DOJ) announced that it proposed a new rule to grant the right of possession of weapons to thousands of Americans who are currently prevented from having firearms.
As states, the proposed rule arises at a time when Trump management continues efforts to reverse weapons regulations, including reductions in the Tax of the National Firearms Law (NFA) over certain firearms.
Currently, under the terms of federal law, people convicted in any court for a crime punishable by prisoner more than one year cannot have a firearm.
The Arms Control Law defines other federal restrictions on weapons possession, such as certain crimes related to domestic violence, immigrant status, toxicode dependents of controlled substances and people who have been involuntarily admitted to mental health centers, among others.
However, the regulation proposed by the DOJ would create a way for individuals with criminal convictions to recover their right to possession of weapons, and final decision by the Attorney General, on a case by case basis.
The Statute allows individuals prevented from having firearms to require the Attorney General to be a measure of correction, as long as they may demonstrate that they do not constitute a danger to public safety or are contrary to the public interest.
There are exceptions
Still, there are specific cases where citizens will not be able to have weapons again. The exceptions are immigrants without document, violent criminals and registered sexual delinquents.
The non -official text of the proposed bill, quoted by Newsweek states that: “The criteria are intended to ensure that the fundamental right of people to maintain and to carry weapons is not unduly infringed, that the persons to whom the exemption is granted are not susceptible to acting dangerously for public safety and that the granting of this exemption would not be contrary to the public interest”.
Num, the Attorney General Pam Bondi He explained the decision, noting that “for too long, numerous Americans with criminal records were permanently prevented from exercising the right to maintain and carry weapons – such as constitutionally consecrated as the right to vote, the right to freedom of expression and the right to the free exercise of religion – regardless of whether or not they represent a threat.”
“The restoration of a federal program for determining firearms will allow millions of Americans to recover their ability to exercise their rights from the second amendment,” said the Foundation’s executive director for the second amendment, Adam herbin Newsweek.
“Many non -violent individuals have been deprived for years of their fundamental rights without constitutional justification,” lamented, in turn, the president of the second amendment legal center, Chuck Michel.
