The Court of Justice of the Federal District and Territories (TJDFT) ordered the removal of publications on Instagram that they called former first lady Michelle Bolsonaro as a former program gang and related their family to criminal records.
The decision was made by Judge Álvaro Ciarlini, from the 2nd Civil Class, in action filed against theonia Mikaelly Pereira de Sousa and Francisco de Paiva Vasconcelos. The contents had already been removed from the social network on Sunday (20).
The measure reformed previous decision of the 1st Civil Court of the Judicial Circumscription of Brasilia, which had denied the request. In revising the case, Ciarlini considered the conflict between freedom of expression and protection of honor and image, both constitutional rights, and concluded that posts were intended to attack Michelle, with content considered misogynist and sexist.

The defense of the former first lady, conducted by lawyer Marcelo Bessa, claimed that the videos contained false and offensive information, characterizing abuse of law. According to the petition, the contents reached more than 1.9 million views in less than a month, which would have amplified the damage to the image of Michelle Bolsonaro.
The decision, published on July 11, established a daily fine of R $ 5,000 in case of non -compliance, limited to R $ 300 thousand, as well as possible criminal sanctions for disobedience.
