In addition to an open arrest for a year, the defendant must also, every three months, present himself to the execution court and take a free online course ‘moral and sexual harassment at work’
A subs was convicted of sexual harassment against a trans woman who served as a cable at a Force Formation School in (RJ). The military received a year in prison in an open regime, there is still appeal in the Superior Military Court (STM).
According to the complaint, in February 2024 the Subfiction would have pulled out by the arm and said “at the time of the ship I didn’t have the courage to crack you, but now that you are a woman, if you give it soft,” remembering the period before the gender transition, when they served together. The case generated an anxiety crisis in the cable the next day, preventing her from maintaining training in the morning.
The military’s defense denies that the situation has occurred and states that the agency only asked which cable pronoun I would like to be treated, and apologize for calling it in the male previously.
The Permanent Council of Justice, however, considered that the victim’s word and the evidence of psychological shaking, such as the anxiety crisis accompanied by physical symptoms and fainting, were enough to certify the case of harassment, no matter how witnesses could not corroborate the cable narrative.
This was added to the fact that “the defendant, during his interrogation in court, several times referred to the offended in the male, using the pronoun ‘he’, although cable is admittedly a trans woman,” said Judge Mariana Aquino, responsible for the case.
In addition to an open arrest for a year, the defendant must also, every three months, present himself to the execution court and take a free online course “moral and sexual harassment at work”, offered by the Federal Senate.
