The Federal Supreme Court Judge Alexandre de Moraes ruled on Thursday that former President Jair Bolsonaro committed an isolated irregularity of the precautionary measures imposed on him by the court and will not be arrested.
Moraes responded to the allegations of Bolsonaro’s defense about the alleged breach of precautionary measures and clarified that, before the arguments and conduct of the former president, it is not necessary to decree pre-trial detention.
“Because it is an isolated irregularity, without news of other non-compliances so far, as well as the allegations of the defense of Jair Messias Bolsonaro from the ‘absence of intention to do so, so much so that it has been strictly observing the rules of payment imposed’, I stop converting precautionary measures into pre-trial detention, warning the defendant, however, that if there is new non-compliance, the conversion will be immediate.” Moraes in the decision.
Jair Bolsonaro’s lawyers had been summoned to comment on a possible violation of these restrictions, after the former president participated in an event in the House of Representatives with dozens of deputies on Monday, which was broadcast on social networks.
Moraes decreed last week new precautionary measures against the former Brazilian chief of state, including the use of an electronic bracelet, mandatory to stay at home between 19:00 and 06:00 Monday to Friday and full time on weekends and holidays, and cannot maintain contact with foreign ambassadors and authorities.
The judge justified this decision with the argument that there were evidence of crimes of “coercion, obstruction” of justice and “attack on national sovereignty,” according to the Federal Police report.
Bolsonaro and his son and deputy Eduardo Bolsonaro, who has been in the United States for five months, sought to “induce, instigate and assist” Donald Trump’s government “in the practice of hostile acts against Brazil”, with the objective of “filing” the process of the coup, according to the Brazilian police investigation.
The former Brazilian president and far-right leader in the country faces a criminal trial on charges of “leading” a coup plan to stay in power and prevent the possession of his successor, Luiz Inacio Lula da Silva, after losing the 2022 elections.

The Republican leader claimed that Bolsonaro is being the victim of a “witch hunt” and demanded that the trial “immediately end.”
