Senator (-RJ) filed a request for Minister Alexandre de Moraes, of the Supreme Federal Court, after the magistrate imposed precautionary measures against his father, the former president (PL).
In the request, the senator cites the recent decisions of the magistrate against Jair and the federal deputy (PL-SP), brother of Flávio, and alleges a crime of responsibility.
“His decisions demonstrate clear breakdown of isonomy, active bias and use of state power for political persecution, which characterizes a crime of responsibility pursuant to Articles 39, items 2 and 5 of Law 1.079/1950, therefore requiring immediate constitutional response to the preservation of the rule of law,” the document says.
The parliamentarian recalls a trip from the then president (PT) to the United Nations in 2016 to contest his impeachment process, and the trips of the then Lula (PT) lawyer to Europe to present the thesis of judicial persecution against the petista. Flavio says there was no interpretation of sovereignty attack and questions why this would now be different with his brother’s performance.
“The answer is clear: it is a selective and discriminatory treatment, which seeks to suppress the legitimate political manifestation of certain actors due to their ideological position, something that frontally hurts the principle of equality (art. 5, caput, of the CF), freedom of expression (art. 5, IV and IX), and the republican foundations of impartiality and legality in judicial action.”
The senator also classifies as “inevitable consequence” of Moraes’s decisions “the suppression of public debate and the creation of an environment of fear, censorship and arbitrary restriction, incompatible with democracy.”
The 22 -page text was filed on Wednesday during the parliamentary recess. Flávio is in Europe with his family. He already had a vacation scheduled before Moraes’s recent action against his father, who put an electronic anklet.
The impeachment request will add to more than 20 that have already been filed in the Senate but never taken later.
The senator was criticized by pockets in 2024 for saying during the program that he believed that an impeachment of STF minister would not solve the problem and that the court needed to self -regulate. In an interview with Sheet This year, the parliamentarian said this scenario was no longer possible.
“At that moment, I believed in a self -regulation of the Supreme. As I have seen that it is not happening, there is no other way but the impeachment of Moraes,” he said in June.

The defense promises that Bolsonaro will not manifest until it is clarified exactly what it may or may not do regarding interviews.
On Monday (21), Moraes banned the transmission or broadcast of videos or audios of interviews of the former president on social networks. Bolsonaro took a reprimand and threat of arrest after talking about improvisation at the exit of the camera, in a scene where he exhibited his anklet and was republished by the press, by supporters and critics on social networks.
