Former first lady Michelle Bolsonaro celebrated on social networks on Tuesday (22.Jul.2025) that of the Supreme Court Minister Luiz Fux against the maintenance of precautionary measures imposed on the former president (PL). Despite the divergence, the score ended with 4 votes to 1 for the continuity of determinations.

Minister Luiz Fux was the last to vote on Monday (21.Jul) and diverged from colleagues about the use of the electronic anklet and some restrictions, stating that the Federal Police and the PGR (Attorney General’s Office) “No new and concrete evidence in the case file of any attempted escape undertaken or planned by the former president”. The restrictions were determined by Moraes in the inquiry that investigates the performance of the licensed federal deputy (PL-SP) to pressure authorities from the United States, during the government of Donald Trump (Republican Party), in actions against the STF. The investigation aims at a possible attempt to obstruct the criminal action that deals with the attempted coup d’état in 2022.
The minister states that Bolsonaro used social networks to support foreign demonstrations contrary to the Supreme Court and publicly conditioned the end of sanctions to the granting of a criminal amnesty in his favor.
“The actions of Jair Messias Bolsonaro demonstrate that the defendant is acting willful and consciously in an illicit way […] in order to try to submit the operation of the Federal Supreme Court to the sieve of another foreign state, through hostile acts derived from spurious and criminal negotiations ”wrote Moraes.
Given this, the magistrate understood that there is a concrete risk of obstruction of justice, continuity of criminal practice and possibility of escape.
“The situation described reveals urgent and undeclain necessity, able to justify the imposition of new precautionary measures that may ensure the application of criminal law and avoid the defendant’s escape.”he said.
