The Public Prosecution Service filed an inquiry on July 14 to investigate possible irregularities in a contract with the company Athru Engenharia.
The value of the contract, signed in 2022, is R $ 14,024,449.85 for the construction of slope containment and recomposition of the drainage system in the Parelheiros region, south of the capital.
Prosecutor Werner Dias de Magalhães had the City Hall, the company and the Secretary of Works, Marcos Monteiro.
The inquiry, according to Magalhães, aims to identify whether there was a failure in the planning of SIURB, “which would have usually used the justification for exemption dismissal by emergency.”
To investigate possible irregularities, the Public Prosecution Service is based on an audit of the 2003 TCM (Court of Auditors) on contracts of the Municipal Secretariats of Urban Infrastructure and Works and Subprefectures, folders that concentrate emergency contracts.
The court points out that “in about 90% of the selected works, it appears that SIURB acted with insufficient planning to address historical problems.” Thus, the agency concludes that “this type of hiring distinguishes it from the actual emergency, calling itself a manufactured emergency”.

In a statement, SIURB states that emergency hires formalized by the portfolio are backed exclusively by technical criteria and imminent risk assessments to the lives of citizens or collapse of structures.
“The works of containment of slope and recomposition of the drainage system of Manuel da Nóbrega de Albuquerque Street began in September 2022, after technical survey of SIURB that identified a situation of serious commitment of security of residents of the region,” says the city.
The note also states that the secretariat “vehemently refutes the irresponsible assumption of possible emergency manufactured”.
“The work was completed in March 2023, after the full execution of the services provided for in the contract. SIURB continues to cooperate with the Public Prosecution Service and will provide the information requested on time,” Nunes Management continued.
