This Thursday (24), Minister Alexandre de Moraes, of the Supreme Court (STF), decided to maintain the precautionary measures applied to the former President of the Republic Jair Bolsonaro (PL).
In response to the defense of the former Mandant, the magistrate did not determine Bolsonaro’s arrest for understanding that the breach of the precautionary was a “isolated irregularity.”
Defense response
The imbroglio on the precautions began last Monday (21), when using social networks, directly or indirectly.
At the time, the former president went to the House of Representatives and, surrounded by parliamentarians allies, journalists and cameramen.
“I didn’t steal the public coffers, I didn’t divert a public appeal, I didn’t kill anyone, I didn’t travel anyone. This is a symbol of the maximum humiliation in our country. An innocent person,” said Jair Bolsonaro.
The photo reverberated by the networks and the moment was shared by the licensed federal deputy, Eduardo Bolsonaro (PL-SP). Therefore, Moraes understood that it is an attempt to circumvent the imposed measures.
In the document referred to the magistrate, Bolsonaro’s lawyer claimed that he, as the precautionary measures initially imposed not prohibited press statements.
No arrest decreed
In the decision this Thursday, Moraes, claiming that non-compliance with the precautions was a “isolated irregularity”.
“Because it is an isolated irregularity, without news of other breaches so far, as well as the allegations of the defense of Jair Messias Bolsonaro from the ‘absence of intention to do so, so much so that it has been strictly observing the rules of payment imposed’, I stop converting precautionary measures into pre-trial detention, warning the defendant, however, that, if there is new non-compliance, the conversion will be immediate.” the minister.
Interviews are not prohibited
Since the beginning of the doubt about the permissibility of conducting interviews, Bolsonaro allies have used this agenda to name.
This week, the former president even canceled, last Monday (21), in the nick of time, an interview with fear of being penalized.
In today’s decision, however, Moraes reiterated that, but to make use of social networks, directly or indirectly, through third parties.
“At no time has Jair Messias Bolsonaro been prohibited from giving interviews or giving speeches at public or private events, respecting established schedules and restrictive measures,” he says.
“The explanation of the precautionary measure imposed on 17/7 by the decision of 21/7, made it clear that the use of subterfuges to maintain the practice of criminal activities, with the instrumentalization of interviews or public discourses such as ‘prefabricated material’ for later social networks of previously coordinated third parties, will be allowed.
The former president has avoided contact with the press since the beginning of the week.
Arriving in a religious ceremony on Thursday, for example, Bolsonaro was approached by journalists, but quickly said:
“Mode of operation”
According to Moraes, the “instrumentalization of public interviews or discourses such as ‘prefabricated material’ for further posts on social networks of previously coordinated third parties” will not be admitted.
He also criticized and prohibited the use of what he called a “modus operandi criminal”, focused on the dissemination of various publications on third party social networks, even citing the use of “digital militias” and “previously coordinated” political supporters.
“Obviously, it would be not logical and reasonable to allow the use of the same criminal modus operandi with various posts on third party social networks, especially for ‘digital militias’ and previously coordinated political supporters for the dissemination of illicit conduct that could be practiced by Jair Messias Bolsonaro, whether in public acts, but always with the purpose of continuing to induce chief and to instigate chief of chief of chief Foreign State to take action to unlawfully interfere with the regular course of judicial process, in order to result in social pressure in the face of Brazilian authorities, with flagrant attack on national sovereignty. “
In Moraes’s understanding, it was precisely from this “modus operandi” that Bolsonaro used when he exhibited the electronic anklet in the House, an image later shared by Eduardo Bolsonaro.
“Justice is blind, but not fool”
In the document published by Moraes, the magistrate warns that a.
“As several times I pointed out in the presidency of the Superior Electoral Court, justice is blind but not foolish !!!!!”, wrote Moraes.
