ZPEs are areas with favored tax treatment to stimulate companies that produce goods and services aimed at the foreign market. Today there are 17 ZPES in 16 Brazilian states.
The measure determines that all the electricity used by ZPE companies comes from renewable sources, such as solar or wind. The obligation only applies to companies that begin to operate after the publication of the MP on 21.Jul. It does not apply to power generation for its own consumption within the respective SPA.
The MP also extends the tax benefits of SPA to companies that provide services linked to the industrialization of goods for export. To this end, these provisters need to have a contractual link with a company authorized to operate in SPA.
When the bond is undone, the company installed in SPA or the service provider will have 30 days to communicate the fact to CZPE (National Council of Export Processing Zones), linked to the Ministry of Development, Industry, Commerce and Services.

The proposal has as its backdrop the objective of attracting data centers – operations that require high energy consumption – into the ZPEs, taking advantage of tax and customs incentives. But, according to Helson Braga, president of (Brazilian ZPEs Association), the requirement of newly opened renewables can create an obstacle to the installation of companies from other sectors, such as traditional industry or service providers.
Processing
MPs have immediate force and effect, but need to be approved by the National Congress within 120 days to avoid validity. The MP will pass through the mixed committee of deputies and senators and will be voted on in the plenary of the House and Senate.
