The court suspended on Friday (25) resolution of the CFM (Federal Council of Medicine) that it limits the treatment for young trans.

Federal Judge Jair Araújo Facundes of the 3rd Federal and Criminal Federal Court of the Judicial Section of Acre determined the suspension of the text and also that changes in the previous resolution of the CFM on the subject of 2019 are subjected to debate and deliberation with the participation of at least the same bodies and entities that made the proposal six years ago.
In the decision, Facundes says he does not discuss whether the CFM has a regulatory power on professional medical proceeding, but claims to have “genuine disagreement about the limits of this regulatory power when the subject involves other areas of knowledge, such as psychology, nursing, nutrition, which remove the regulatory power of a single professional council.”
The judge stated that the resolution had no grounded and evidence -based medicine reasons for changing the normative treatment of young trans and said that the.
In addition, he stated that the resolution had no “legitimacy by not including the participation of representative entities in the deliberative process, incurring serious procedural error”.
Facundes also argues that the norm “brings the potential for damage by demanding patient registration, violating constitutional law to privacy and intimacy”, among other points.
For federal deputy Duda Salabert (PDT-MG), the decision is a “fundamental victory for the rights of trans people”.
“She recognizes what we always denounce: this norm was a political measure, without scientific basis,” he says. “Trans health should be guided by evidence and respect for autonomy, not by prejudice and radicalized political positions that try to appropriate the Federal Council of Medicine.”
