Senator Jorge Kajuru, author of the proposal, wants to increase 6 -month punishment to up to 4 years due to social networks

The penalty for apology for crime can increase from 6 months to up to 4 years in prison. PL 2,830/2025, presented by Senator Jorge Kajuru (PSB-GO), proposes to raise punishment for those who praise or stimulate crimes or criminals of 3 to 6 months of detention or fine for 2 to 4 years of detention and fine.

Kajuru considers the current penalty very mild, especially in the face of Brazil’s social transformations in recent decades.

“The increase of the penalty is also justified due to the potential diffusion of apology in social networks, an unthinkable circumstance at the time of coding, dated more than 80 years.”justified the parliamentarian.

The senator recalled that posts from influencers stimulating crimes or praising criminals can reach thousands of followers. This propagation, according to him, can lead to acts of delinquency or create a conducive environment for this type of activity.

The project on increased punishment for apology for crime will be distributed for debate and voting in the appropriate Senate committees.

In 2023, the Ministry of Justice and Public Security published a decree to avoid apology for crime, considering that criminal activities are encouraged by posts on social networks. However, the text was vacant.

At the Ordinance, Senacon (National Consumer Secretariat), within the scope of administrative process, should request that social networking platforms evaluate and take mitigation measures related to systemic risks arising from the operation of their services and related systems, including algorithmic systems.
