The minister, of the (Supreme Federal Court), determined on Monday (28) to change his uniforms for civilian clothing to participate in the interrogation.
The order only arrived for the military arrested after the beginning of the hearing. The lieutenants and had to leave the session to change their clothes.
Auxiliary judge Rafael Henrique Tamai Rocha of Moraes Office said the decision was taken by the “Minister-Report to the extent that the accusation is focused against the military and not against the Brazilian Army as a whole.”
Defendant Rafael Martins de Oliveira refused at first to change the uniform. He only agreed to change clothes after Moraes decide that the military would have ten minutes to be available to give the statement. Otherwise, the Supreme would consider that the lieutenant colonel would have been silent.
The order was questioned by the defenses of the military. Oliveira’s lawyers argued that Moraes’s decision is not in the case file.
“He is uniform because he is active military and is arrested in a military unit. Obviously, he is uniformed in the military unit in which he is arrested. What they suggested is something that undermines both the dignity of the officelato and the accused,” said one of the lawyers of Oliveira.
He stressed that the military has no appropriate civilian clothing for the hearing of the case in prison and that it was suggested to Oliveira to borrow a clothes under penalty of not participating in the interrogation. “
Lawyer Luciano Pereira, from the defense of Ferreira Lima, said that the same order arrived for the military at the beginning of the hearing. “He had to look for a borrowed outfit that was not his to participate in such a sublime and important moment for him, who waited more than 8 months in prison to speak,” he said.
