The senator (PT-ES) filed a bill to authorize the magazine people, belongings and vehicles when there is a suspicion of some criminal offense, with the aim of “closing the gaps that now feed impunity.”
The text filed by the senator alters the search and seizure chapter of the Criminal Procedure Code. He adds that the magazine “includes the body of the person, their robes, their belongings and their vehicle and may be made by police or municipal guards, when there is a suspected criminal offense.”
In justification, the petista senator states that in February this year the (Supreme Federal Court) fixed the thesis that it is constitutional, within the municipalities, the exercise of urban security actions by the municipal guards, including ostensive and community policing.
“Thus, the STF has corroborated the understanding that municipal guards can perform typical acts of ostensive or preventive policing, such as personal search and arrest in the act,” argues Contarato. However, it continues, the Supreme Court did not explicitly use the expression “personal search”, which made the parliamentarian present the project.
“We took the opportunity to clarify that the personal search can involve the body, the clothes, the bag, the folder, the backpack, the wallet and the searched car, among other personal effects,” he says in the text.
The Contarato panel says the idea came from his police career. “I was delegated for 27 years and I know, from experience, that at the time of despair the population does not ask if who is there is a military police or a municipal guard. She wants protection,” he says. “He wants to be rescued by someone who represents the state and who has the mission to guarantee his safety.”
