The Court of Justice of São Paulo ordered last Friday, 25, that the former attorney of the Republic Deltan Dallagnol, who was coordinator of the extinct Lava Jato operation, pay within 15 days the compensation of R $ 135,400 to President Luiz Inacio Lula da Silva (PT) for moral damages for the disclosure of PowerPoint to illustrate the triplex complaint in 2016.
The amount had been set at R $ 75 thousand by the Superior Court of Justice (STJ) in 2022, but was updated with monetary correction and interest application. According to the order of compliance with the judgment, issued by Judge Carlo Brito Melfi, if Dallagnol does not comply with the payment term, he may receive a 10%fine, in addition to attorney’s fees of 10%.
The case is no longer appealed, as the last presented was rejected by the Supreme Federal Court (STF) in June last year. However, Dallagnol may also question the correction of the amount of compensation. Estadão sought the former attorney to comment on the case, but has not yet returned.

At the time, Dallagnol stated that the STF is on “honeymoon” with the government. “There is nothing more tyrannical and dangerous for the rule of law and democracy than a judiciary who decides politically, punishing enemies and benefiting allies,” he said in a statement.
In deciding on the conviction, they concluded that there was “excess” in detailing the complaint to the press and that the former attorney offered the petista’s honor and reputation.
In 2016, Deltan Dallagnol participated in a press conference to clarify the complaint related to the case of the Guarujá triplex. At the press conference, the former prosecutor used an image created on PowerPoint to point Lula as “Maestro” and “Commander” of the criminal scheme investigated in Lava Jato.

According to Lula’s lawyers, Dallagnol injured the petista’s personality rights in a national television network, exercising a judgment of guilt even before the beginning of the criminal action, besides bringing accusations that were not even part of the complaint. Also according to them, the press conference was replicated in the Brazilian and international media, expanding the dimension of damage to the image of the president.
The case of the triplex led to Lula’s first conviction in Operation Lava Jato, imposed by then Judge Sérgio Moro, with an initial sentence of nine years and six months in prison, reduced to 8 years, 10 months and 20 days. After 580 days arrested, the petista benefited from a decision of the Supreme who recognized nullities and extinguished the actions against him.
In April 2021, the Supreme Court declared the suspicion of former federal judge Sérgio Moro by condemning Lula in the action of the Guarujá triplex. The ministers voted for the understanding that Moro was partial in the case while acting as a judge at the 13th Federal Court of Curitiba.
