The Minister of Environment and Climate Change, said, on Tuesday (29), that the President It should veto some excerpts from the Bill (PL) 2.159/21, which deals with the rules of environmental licensing. According to the minister, the government’s decision is to “preserve environmental licensing”. “There is already a decision, that it is necessary to preserve Brazilian environmental licensing, that it is necessary not to demolish one of the main environmental protection tools in Brazil, not to create a situation of widespread legal insecurity, that it is necessary to respect existing laws. Many of them can not be changed in the way that has been proposed,” said Marina. For her, the eventual sanction of the project will represent a “demolition” of Brazilian environmental legislation.

During an event to commemorate a year of the National Integrated Fire Management Policy, in Brasilia, the minister stated that the government studies a measure to replace changes in legislation, but did not clarify whether the proposal will be forwarded by a provisional measure or a bill. “It is not enough to veto. It is necessary to veto and have something to put in place. It is not only seen the question of veto, but how to properly repair what may be changed,” said the minister. Sent to presidential sanction, the bill provides for the simplification of procedural procedures, with the creation of new types of environmental licenses, and the reduction of analysis deadlines. President Lula has until the next 8th to sanction or veto the final text that the Chamber of Deputies approved on the 17th.

Marina reported that teams from the MMA, the Civil House and the Ministry of Institutional Relations are analyzing the changes in the text, which should be sent soon to the president. The look falls on the proposal as a whole, not just the changes approved by the deputies. “The president will have the information on your table so we can decide,” he said. “The government’s strategy is: it is clear that it is not enough to veto, it is necessary to put something in place, and this has to do with the alternatives provided to the executive branch, or you do this repair by bill or MP,” he concluded.

National Policy

The National Fire Management Policy was instituted by Law No. 14,944, sanctioned by President Lula on July 31, 2024. The proposal establishes principles, objectives and instruments for the use of fire in a safe and sustainable way, considering traditional and scientific knowledge. In addition, the law creates a new form of fire governance, compatible with the challenge imposed on climate change. It is up to the Federal Government to coordinate actions between state and municipal governments, civil society, traditional communities and private sector in fire management, defining guidelines for the performance of each of these actors in a dialogued and integrated manner.
