There is a new obligation that will become part of the annual routine of those who receive pensions. The process is simple, but ignorance may be expensive. The measure applies gradually, but some beneficiaries will have to comply with this year, otherwise they see their pension suspended.
The measure was published this week in and determines that all pensioners will have to present proof of life annually, from the year following the beginning of the pension or change of residence. For some, the deadline starts in 2025.
Who has to fulfill this year?
According to the Ordinance of the Ministry of Labor, Solidarity and Social Security, pensioners over 66 years residing in Switzerland or Luxembourg will be notified by the end of September and will have to present life proof until November 30. If they fail this period, the payment of the pension will be suspended from January 2026.
In 2026, it widens more countries
The new regime will be implemented in a phased way. In 2026, it will also cover pensioners resident in the Netherlands, Belgium, Cape Verde and the United Kingdom. In 2027, the measure will be applied to all retirees to live outside Portugal.
What will be the routine from now on?
Starting next year, the covered pensioners will be notified every year in April. The proof of life must be done between May 1st and September 15th. If it is not completed by this date, Social Security may request a new test, with a deadline until October 15th. If you fail, the pension will be suspended the following month.
Who is exempt?
Pensioners resident in countries with which Portugal have data exchange agreements that ensure effective knowledge of deaths are exempt from fulfilling this obligation. However, the full list of these countries has not yet been disclosed.
How to take the proof of life?
There are three possible ways: digital, face -to -face or documentary.
In the digital method, the process is done in direct social security with authentication and facial recognition.
The pensioner must show a valid identification document and his face.
If you prefer to do it in person, you can move to an embassy, consulate or a Social Security Care Service in Portugal.
Attention to compulsory registration
The tests made in person are only valid if they are recorded in direct social security. When this is not possible, it is necessary to submit its own statement, available on the Social Security website, duly completed and signed.
Other ways to prove the situation
International forms or documents issued by local authorities such as courts, notaries, municipalities or health entities are also accepted, provided that they include the presential recognition of the signature.
What if you can’t do it for you?
If the pensioner is unable to do so in person, he can appoint a legal representative. In this case, it is necessary to present a medical evidence of the impossibility, a copy of the representative’s identification document and the legal document that gives him powers for this purpose.
Why this new requirement?
According to the government, the objective is to avoid improper payment situations after the death of pension beneficiaries, something that has cost about 11 million euros to the state in 2024 alone.
