The consequences of the arrest of licensed federal deputy Carla Zambelli (PL-SP) in Italy also began to reach those who helped her hide. The Attorney General of Rome opened an inquiry to investigate the Brazilian who shelter to the parliamentarian in an apartment in the Aurélio neighborhood, upper middle class area in the West Zone of the Italian capital. The information was determined by the portal UOL.
According to the Ministry of Justice of Italy, the case follows a standard procedure provided for in the country’s legislation, which typifies as a crime of personal favoritism to shelter to someone convicted or sought by the court, a condition in which Zambelli was after being at the request of the Supreme Court (STF).
Zambelli was arrested last Tuesday (29) in the rented property, with estimated rent in 1,500 euros (about $ 10,000), shortly after giving an interview to the Italian newspaper The Republic.

The person responsible for delivering the location of the parliamentarian to the Italian police was the Europa Verde Party. According to him, the address arrived at him at 6:40 pm (local time), and was passed on to police at 7:50 pm. The arrest was made around 9 pm, which belies the initial allegation that the deputy would have voluntarily surrendered to the authorities.
Custody hearing this Friday
The deputy must undergo a precautionary custody hearing this Friday (1st), at 6am (Brasília time), in the 4th Section of the Court of Appeal of Rome. The session will be conducted by Judge Aldo Morgigni and will take place at closed doors. Zambelli may participate in person or by video conferencing, accompanied by his lawyer in Italy, Pieremilio Sammarco.
At the hearing, the judge will question whether the deputy agrees to be sent back to Brazil. If you refuse, a formal extradition process will be opened, which may drag it for months.
Continues after advertising
Brazil has already sent the request for extradition to Italy, based on the condemnation of Zambelli to 10 years in prison for invasion of the National Council of Justice (CNJ) system and ideological falsehood, with res judicata. From the hearing, it will be up to the court of appeal to analyze whether the legal requirements were fulfilled – whether the conviction is definitive and if there was respect to the right of defense.
Even with a favorable opinion of the Court, Zambelli may resort to the Court of Cassation, higher instance of the Italian justice. The final word, however, will be from the Ministry of Justice of Italy, led by Carlo Nordio, who may authorize or block extradition by political-administrative criteria.
If the extradition is authorized, the defense may still appeal to the administrative sphere in the Regional Administrative Court (TAR), further prolonging the parliamentary’s permanence on Italian soil.
