By the rules of Italy, the extradition process involves two judicial instances – the appeal court itself and, later, the cassation court. Only after the trial in these spheres will it be up to the Minister of Justice of Italy, Carlo Nordio, to make the final decision, of a political-administrative nature. It is estimated that the entire process light between one and a half and two years.
If the Court considers that extradition meets legal requirements – such as definitive conviction and respect for the right of defense – and if the Italian minister agrees with the Brazilian request, Zambelli may be returned to the country to serve the sentence.
Mandate
Parallel to international process, the STF has already determined the loss of Zambelli’s parliamentary mandate. The decision still needs to be formalized by the House of Representatives, which must occur from the analysis of the Constitution and Justice Commission (CCJ), scheduled for August.
