Action asks the Supreme Court to prohibit any Brazilian financial institution to execute measures provided for in Magnitsky Law; Party states that banks cannot be instruments of retaliation
The PT (Workers Party) filed a lawsuit at the Supreme Court (STF) to prevent financial institutions in Brazil from applying sanctions to Minister Alexandre de Moraes based on the US government decree that included it in the so -called Magntsky Law. The measure was taken after President Donald Trump’s government announced last Wednesday (30) sanctions against Moraes, which include the prohibition of entry in the US and the blockade of goods. The decree also prevents companies with assets in the US territory from providing services to the minister, which can affect their banking relations in Brazil.
The action filed by the PT – through the party leader in the House, Deputy Lindbergh Farias (RJ) – asks the Supreme Court to prohibit “any Brazilian financial institution, public or private, to execute, replicate or give material effectiveness” to the measures provided for in American law. In the argument, the party states that applying bank sanctions to Moraes would mean a “transfer of sovereignty incompatible with the Brazilian Constitution” and a violation of the judiciary’s independence.
The text also warns of the risk of banks become instruments of retaliation against magistrates for decisions made in the performance of their duties. Among the examples cited are the possibility of freezing accounts, cancellation of services or refusal to issue credit cards for non -technical, but political or ideological reasons.
Magnitsky law was created in the US to punish individuals accused of serious human rights violations such as torture and murders. Moraes is the first authority of a democratic country to be included in the list of sanctions. Activist William Browder, responsible for promoting the approval of the law in 2012, criticized the Trump government’s decision and classified the episode as a “shameful moment.”
