STF Minister argues that ‘the defendant has reiterated criminal conduct several times through the production of images and audio and video connections, regarding coercive measures, with a clear purpose of obstruction of justice’
O do said on Monday (4) that the former president continues to “ignore and disrespect” the Supreme Court. The minister’s conclusion is in the decision (access here the full document) in which he ordered Bolsonaro’s house arrest for breach of the precautionary measure that prevents him from using social networks, including through third parties, during the support acts performed on Sunday (3) across the country. “Ignoring and disrespecting the Federal Supreme Court (STF), the defendant reiterated his criminal conduct, several times, both in the production of images and in the audio and video calls, as well as in the massive dissemination of his support, via the dissemination of his images on social networks, in relation to coercive measures, with the clear purpose of obstruction of justice,” he said.
For the minister, non -compliance with the precautionary justifies the decree of house arrest. “The conduct of Jair Messias Bolsonaro deliberately disregarding the decisions made by this supreme cut, demonstrate the need and adequacy of more serious measures in order to prevent the defendant’s criminal continuous reiteration, even with the imposition of various precautionary measures of prison,” he added.

Last month, Moraes determined several precautionary measures against Bolsonaro, including the use of an electronic anklet and restriction to the use of social networks, including third party profiles. In the decision issued last Monday (4), the minister pointed out that Flávio Bolsonaro and two other sons of former president, Carlos and Eduardo, published on their social networks Bolsonaro’s thanks to supporters who attended the acts performed yesterday (3). Thus, according to Moraes, there was non -compliance with the restrictions determined above.
The precautionary measures were determined in the inquiry in which Eduardo Bolsonaro, a federal deputy for the São Paulo PL, is investigated for his performance with the government of US President Donald Trump to promote retaliation measures against the Brazilian government and ministers of the Supreme. In March this year, Eduardo asked for a parliamentary mandate license and moved in the United States on the grounds of political persecution. In this process, the former president is investigated for sending resources via Pix to pay for his son’s stay abroad. Bolsonaro is also a defendant in the criminal plot’s criminal action in the Supreme. The trial is expected to take place in September.
