Jair Bolsonaro’s house arrest marks another chapter of intense political polarization in Brazil

Bolsonaro is a defendant in proceedings about attempted coup d’état, but the house arrest warrant is linked to the investigation of obstruction of justice. In this inquiry, Deputy Eduardo Bolsonaro (PL-SP), son of the former president, is appointed as an articulator of possible foreign sanctions to the Brazilian judiciary during travel to the United States.

On social networks, federal deputy Guilherme Boulos (PSOL-SP) mocked: “an ankle at a time towards Papuda”, alluding to the use of electronic anklet imposed on the former president. Deputy Erika Hilton (PSOL-SP) also mocked the measure: “With that, the former president will not be able to leave home even before 7 pm, making our streets safer.”

PT’s national president, Edinho Silva, also came out in defense of the measure taken by Moraes: “If there is a order of the Supreme and it is breached, it is evident that the judiciary has the prerogative of increasing the proposed penalty,” he wrote. Edinho also argued that the investigation into an attempted coup and the alleged criminal organization that would have tried to assassinate authorities from the Republic.

Moraes’s decision is based on the understanding that Bolsonaro has “deliberately and consciously” violated precautionary measures imposed by the Supreme Court. Among the infractions is his participation, albeit remote, in an act held this Sunday (3) by supporters in Copacabana, Rio de Janeiro. According to Deputy Lindbergh Farias (PT-RJ), Bolsonaro appeared in a video call during the event, which would configure a new violation.

“In addition, (Eduardo Bolsonaro) continues to promote foreign sanctions against Brazil and paying against national sovereignty in articulation with international political actors,” said Lindbergh, adding that the Supreme response was “proportional to the severity of acts.”

The decision states that Bolsonaro complies house arrest with electronic monitoring and imposes severe restrictions: it is prohibited from receiving visits, except lawyers and close family members, and is prevented from using cell phones or maintaining communication with ambassadors and other investigated. Representative Sâmia Bomfim (PSOL-SP) merely said “great day” when commenting on the news, while Mrs Jandira Feghali (PCdoB-RJ) stressed: “No one is above the law.”

Moraes made it clear that if there is a new breach of the measures, the pre -trial detention may be decreed immediately, as provided for in the Criminal Procedure Code. The process in question, PET 14129, investigates crimes such as coercion in the process course, attempted to abolish the Democratic Rule of Law and obstruction of investigation into criminal organization.
