Following the election of the president (PT) in October 2022, a blue pickup truck approached the Nikin Lanches in the city of Cafelândia, in the interior of São Paulo, and a small bomb was thrown against the establishment, causing fear and revolt.

The attack had the right address. The snack name was in one released by members of a Whatsapp group called “Patriotas Cafelândia”, supported by (), who nominally cited “leftist and traitory” service providers and service providers who should be “banned”.

In late July, almost three years later, the São Paulo courts condemned two people accused of elaborating and released the boycott list: Professor Davoine Francisco Colpani, 68, and dentist Edson Parra Nani Filho, 62.

They were convicted in the second instance for persecution. The teacher received a sentence of one year, four months and ten days in open arrest. The one year, five months and fifteen days dentist, also in open regime. The two have benefited from the conditional suspension of the sentence, but will have to pay, individually, compensation of two minimum wages for each of the seven people mentioned on the list that registered formal complaint.

In the complaint made to the court, prosecutor Thiago Cardim said that “in addition to offending the democratic regime, the unbridled dissemination of the boycott list now causes embarrassment and risks to the physical and psychological integrity of the victims.”

According to the prosecutor, the people mentioned began to be offended and disturbed on the streets and in their workplaces, as well as suffering financial losses.

One of the victims reported to the Public Prosecution Service that, a week before the second round, a person sought him that if he did not declare vote in Bolsonaro and put a Brazilian flag at the door of the establishment, his name would be included in the boycott list, as it actually occurred.

“I felt embarrassed, shaken. We are afraid, we are working and do not feel well, give the impression that someone will come anytime and do something with us,” he said in a statement.

Attorney Márcio Sérgio Christino said at the trial that the boycott list was replicated on other social networks and also distributed in leaflets.

In condemning the teacher and dentist, Judge Luís Soares de Mello, rapporteur of the case at the São Paulo Court of Justice, said that “the reports provided by the victims are fully corroborated by the witnesses and documentary proof, with prints of the Whatsapp application, reinforcing the likelihood of the allegations and highlighting the reiterated and intimidating character of the defendants.”

Sought by Sheetlawyer Tiago Cruz, who represents dentist Nanini Filho, said he should not appeal the decision. “We would like not to comment on the merits of the prosecution, since Edson’s claim is a turning page and life that follows, because it was a exhausting process. He will respect the decision of justice.”

Davoine Colpani’s defense said it will appeal. Lawyer José Rodrigues Santana Gomes told the report that his client is being convicted without any proof of the allegations made in the complaint, “since he did not create or disclose the alleged list.”

To justice, Davoine said he was not the creator of the list and does not remember who referred to when he sent the message “another traitor to be banned”, or the meaning of the sentence. He stated that the message sent did not keep any relationship with the list released in the group “Patriots of Cafelândia”.

His defense also pointed out that the “unknown person who practiced the bomb attack should be identified and properly penalized”.

“What is the connection of this with the supposed boycott list?” He asked. “It is at least unlikely that the disclosure of an alleged list has generated such serious consequences for the physical and psychological integrity of the victims,” the teacher’s defense told the court.

Nanini Filho said in the process that he was not responsible for posting the boycott and was aware of the list through an acquaintance and sent a message to the group asking for the cessation of its disclosure. He said he doesn’t know who created the list and sought well -known people, cited in the document, apologizing.
