This occurs almost four months after Mesquita filed a lawsuit against Juliana, and requested $ 50,000 in compensation. Thus, the new request would be a response to the defendant’s action, Otávio Mesquita. The case runs in the 11th Civil Court at the São Paulo Court of Justice.
To Estadão, Juliana’s lawyer, Hdio Silva Junior, questioned Octavius’s defense on Tuesday: “It is a contradiction. Initially the defense of Otavio Mesquita (said) that there was no crime, and that there would have been the prescription. The “prescription” of a crime is when, after a certain period of time, there is the loss of state law to punish the individual for the offense.
Sought by Estadão, Mesquita’s defense also defends on Tuesday: “(the new request) does not change our full conviction, not only of the innocence of Otavio Mesquita, but of his right to see the injustice against him, with the condemnation of Mrs. Juliana to the payment of compensation for moral damages, to be reversed to charity.”

Juliana Oliveira accused Otávio Mesquita de rape that would have occurred during a 2016 edition at The Night, Danilo Gentili program at SBT. The video, which can be seen on YouTube, shows Otávio Mesquita coming to the stage hanging from a wire rope. Juliana will help him remove safety equipment and he touches his breasts and other parts of his body. Then simulates sex movements. The scene repeats itself.
The lawyer responsible for the complaint of Juliana Oliveira, Hdio Silva Jr., explains why he decided to continue with the charges of rape. “When I talk about harassment, I am talking about an uncomfortable, eventually vexatious approach. There is no physical touch, there is no erotic touch. Until 2009, rape really required penetration. From then on, the type of rape, practiced by physical violence, has also sheltered the libidinous act, which we call the criminal type open; 015/2009.
However, Mesquita’s lawyer has another vision. “We understand that if the person who is complaining understood this, he would have, at that time, by law, a period of six months to make a representation, which was not made,” said Roberto Campanella. “We are talking about almost ten years later. And we also understand that it is not even close to an act of rape.”
This is why the presenter’s lawyer said in April that he filed an indemnity civil action against Juliana, who began to be processed at the São Paulo Court of Justice (TJ-SP). “We filed the action because of this accusation that we consider very serious and unfounded, and which causes damage in the image of Octavius,” he explains. “We considered an abuse of the demonstration. If someone waited for almost ten years to make such an accusation, we imagined that they could do it for the first place, and not go straight to the media to look for exposure.”
