The government is about to advance with a set of significant changes in working conditions in Portugal. Proposals cover topics such as parental license, breastfeeding, contracts, hours and strike rules, causing different reactions between workers, employers and unions.

Reinforced parental license, but with changes in the subsidy

According to News to the Minute, the initial parental license could reach 180 days, provided that the parents divide the last 60 days equally. The father will be entitled to 14 consecutive days of license shortly after birth, duplicating the current seven.

For 150 days, Parental allowance will maintain 90% payment of daily compensation. Already in cases where the license is shared for 180 days, the remuneration will be 100%.

New rules for breastfeeding and gestational grief

In the case of breastfeeding, a maximum limit of two years will be set for the dismissal of work, something that has not existed so far. In addition, it will be mandatory to present a medical certificate every six months to prove the situation.

Part -time workers are no longer guaranteed a minimum period of 30 minutes to breastfeed.

As for gestational mourning, the three consecutive days of 100% paid absence ceases to exist. Alternatively, family assistance absences may be used, up to a maximum of 15 days, but without any compensation.

Flexible work and limitations on the right to refusal

The possibility of refusing certain tasks or times for those who have children under 12 or dependent on chronic disease will be restricted.

The measure aims to facilitate the organization of companies and may affect cases such as night or weekend work, where the refusal may no longer be accepted.

New rules on disease and just cause

The presentation of a self -declaration of false illness will become a reason for dismissal for just cause. So far, this consequence has only applied to fraudulent medical statements.

Minimum services will cover new areas, including day care centers, homes, food supply and private security. The goal is to ensure that essential functions continue to function during strike periods, although the measure can generate contestation.

Contracts at a right term with new durations and conditions

The right term contracts will now have a minimum duration of one year instead of the current six months, and the maximum limit rises from two to three years. In the case of uncertain term contracts, the maximum period increases from four to five years.

Another change is the possibility of resorting to these contracts in the first two years of activity of any company, not just those with less than 250 workers. The measure also covers reformed and people without previous experience with a term without a term.

Individual hours bank returns with defined limits

The individual time bank will be reintroduced, but only by agreement between worker and company. The limit will be two overtime daily, up to a total of 50 hours per week and 150 hours a year. The reference period may go up to four months.
