The (Federal Supreme Court) elected the minister as president of the Court on Wednesday (13). The vice president will be.
The pair will be in charge for the Supreme. The inauguration is scheduled for September 29.
The presidency of the Supreme Court follows an antiquity tradition. Always holds the office the oldest minister of the court who has not yet been through the function. The election is considered a symbolic act, with secret vote by electronic system.
Edson Fachin completed last ten years of the Supreme. The expectation in the court is that the minister must impose his discreet and conciliatory profile in the presidency of the Supreme Court, with more predictability of the judgment agenda in the plenary.
He assumes the Supreme’s main position as successor to Minister Luís Roberto Barroso, whose most communicative and media style marked his two years in charge of the court.
The election of both ministers was for ten votes – usual, presidential candidates do not vote in themselves.
Soon speech, Barroso wished happiness for the new president and vice of the Supreme Court. “It’s hard, but it’s good,” he joked. Fachin, in response, said the presidency of the Supreme is like a relay race: “The baton arrived here and I receive with the sense of mission and the awareness of a duty to fulfill.”
Fachin, 67, is from Rondinha (RS). He graduated in Law from the Federal University of Paraná and made a master’s degree and doctorate at the Catholic University of São Paulo. He also did postdoctoral in Canada and taught at universities abroad.
He was nominated for the Supreme Court by former President Dilma Rousseff in June 2015. In these ten years, the minister was responsible for more than 53,000 lawsuits on various topics. Some of the thorny ones were resources and actions from Lava Jato – Fachin inherited the processes about the operation after the death of Minister Teori Zavascki in 2017.
This year, the most relevant process of Fachin’s rapporteur judged by the Supreme was the Favelas ADPF, a process that defined rules on police operations carried out in Rio de Janeiro communities.
The process ended in the Supreme after the ministers gathered at closed doors and define consensus on the subject. This must be one of Fachin’s tonics at the head of the Supreme: the attempt to build consensus on complex themes.
In the second most important position of the court, Minister Alexandre de Moraes must prepare the land for its presidency from 2027.
