Former President Jair Bolsonaro’s defense handed his STF his final allegations in the January 8 attack investigation

The defense of the former president handed over to his final allegations in the investigation of the January 8 attack, and said he never acted to prevent the president’s inauguration (PT) and has always defended democracy. “At no time has Jair Bolsonaro practiced any conduct that was intended to prevent or hinder the inauguration of the then president -elect Luiz Inacio Lula da Silva. On the contrary, he always defended and reaffirmed democracy and the rule of law,” says the defense.

The lawyers state that the document found at the house of former Minister Anderson Torres, who provided for the decree of a state of defense, was “apocryphal” (without proven authorship) and that Bolsonaro was never aware of his existence or ordered his elaboration, and that the former Mandator’s meetings with commanders of the Armed Forces were to deal with “institutional affairs” and not to plan a coup d’état. The defense argues that Bolsonaro is “innocent of all imputations formulated in the complaint.”

“The absolute absence of evidence and the manifesto divorce between the prosecution and the law was demonstrated. It was demonstrated that the acts imputed in the complaint could never be qualified as criminals, either because expressly excluded from the scope of criminal incidence by the legislator, or because, even if the logic of the complaint, the acts would be revealed, the text.” Upon delivery of the final defense allegations, the PGR will give its opinion on the case.

Then, the rapporteur minister, Alexandre de Moraes, will prepare his vote, and the case will be taken to trial by the STF plenary, who will decide whether the accusations against Bolsonaro will be accepted, making him a defendant, or if they will be filed. The Supreme Court should judge the case in the coming weeks. Currently, Bolsonaro is under house arrest for trying to disturb the lawsuit of coup d’état, according to the rapporteur of the case, Minister Alexandre de Moraes.
