The Public Prosecution Service had been following the issue for at least two years and held a series of meetings with the City Hall. Prosecutor ahead of the case, Sandra Massud says the problem has worsened in recent times and that management has acted with neglect when dealing with the theme.

“Practically every week judges and tutelary counselors send representations saying they try vacancies and can’t,” he says.

She says that the municipal social assistance technicians themselves have already mentioned exits to resolve the issue, but that management has not been engaged in solving the problem.

“There is a lack of political will to put into practice what they themselves thought of solution,” says the prosecutor. Now MPSP charges a plan in court to resolve the issues.

What MPSP asks for the action

  • In the action, which is a secret of justice, MPSP argues that it survey it to identify all children and adolescents welcomed in Saicas outside their territory, as well as the cases of siblings who are in different shelters.
  • From this data, MPSP asks for a “effective and urgent” plan to be presented for children to be transferred by the Saicos close to their families and kept together with their brothers.
  • MPSP also requires the city to present, within a maximum of six months, a schedule for the installation of new Saicas, with partnerships with organizations or direct administration when there are no interested after two failed attempts in call notices.
  • The agency also argues that management takes an action to disclose the so -called Welcoming Family Service (SAF), through which families can welcome children and adolescents for a certain period of time.
  • The MPSP also claims that the City Hall, within a maximum of 90 days, is a comprehensive care nucleus for homeless children and adolescents and a rear house in the central region of the city, and do studies on the need to create these spaces in other territories.
  • Finally, the action demands training and improvements in the flow of care so that children who may be sent to places far from their territories are transferred within 10 days close to their homes.

O Metropolis questioned the City Hall about the action of MPSP. In a statement, the Municipal Secretariat of Assistance and Social Development (Smads) stated that, between 2021 and 2025, the institutional reception for children and adolescents was expanded in the city with the implementation of 13 new Saicos.

“There are currently 2,230 vacancies, distributed in 149 services. Three new units will be installed in this second semester. It is noteworthy that the institutional reception network for children and adolescents in the municipality also has services such as Casa Lar and Family Welcoming, which together offer 220 vacancies.”

The folder also stated that the city was notified of the action and will adopt the appropriate measures.

Tension in Social Assistance

MPSP action takes place at a time of tension within the city’s social assistance. Earlier this month, organizations officials made a

Protesters claimed salary readjustment, payment of late wages and bargains, the guarantee of agreements that are threatened with closing and defrosting funds to social assistance policies.

O Metropolis He found that members of organizations responsible for the city’s shelters attended a meeting with the OAB Human Rights Commission in July and reported delays in the payment of contracts.

After the demonstration on August 7, the, but spoke of the need to review expenses in care policies, mentioning the cost for the reception of children and the care to the elderly population in the long -term institutions (ILPI).

“Today, we have a situation, for example, from our ILPI. They are our elderly long -term institutes. São Paulo today has 17% of the elderly. We will have, in 2030, 20% of the elderly. By 2050, 30%. That is the following, that in 2050, a third of the population of São Paulo will be elderly. Make a readjustment. I will need to increase spaces, have more elderly people in the same environment, integrate cultural and sports activities of this service, ”said the mayor.

In a press speech, Nunes also denied the delays and said that some value could “have been left behind” for the lack of justification in the provision of service, which would be a punctual issue.
