Senator is the subject of investigation for possible omission in the face of crimes against children at the time when he was minister
Minister Cármen Lúcia of the Supreme Federal Court (STF) has requested that the PGR (Attorney General’s Office) manifests itself on the investigation that investigates Senator Damares Alves (Republicans-DF) committed prevarication when he was a minister of women, family and human rights in the Jair Bolsonaro government (PL). The inquiry was sent to the STF by the TRF-1 (Federal Regional Court of the 1st Region). The investigation refers to crimes against the sexual dignity of children on the island of Marajó, in Pará.
The case points out that on October 8, 2022, Damares Alves publicly stated that he received photos and videos showing sexual abuse against children on the island. But while minister, he did not say which institutional measures were taken.
Sought, the senator responded through her press office that trusts the seriousness and impartiality of the analysis by the Supreme Court.
PGR may request the filing; Request new steps or submit a complaint to the Supreme if you consider there are prevarication evidence.
The demonstration will serve as the basis for the Court to decide the next steps of the process.
In addition to the inquiry, the PGR reported that it processes a public civil action, filed at the 5th Federal Civil Court of Federal Justice in Belém (PA), related to the same facts.
The Federal Prosecutor’s Office has also been notified and must speak on the case. The process continues confidential.
The case was initially taken to the Supreme Court on October 13, 2022, but the court ruled at the time that it had no competence to analyze it. The case was for the 1st instance of the Federal Justice.
The TRF-1 assumed the investigation, but returned the case to the Supreme after change in legal understanding that guarantees the prerogative of forum to authorities for positions related to the position ,.
The rapporteur, Carmen Lúcia, reiterates the point in her order: the forum prerogative now allows the senator to be investigated by the court. Read A (PDF – 147 KB).
