Many drivers do not even imagine that a simple trip with goods in the car can become a nice headache. The line between transporting for personal use and commercial purposes is subtle, and exceeding it can have unexpected consequences. In the present case, we are talking about alcoholic beverages, whose amount transported defines all the difference.
Limits that define commercial purposes
According to Deco Proteste, the special consumer tax code establishes legal presumptions that help distinguish their own consumption from commercial activity.
Article 61 of CIEC defines the maximum limits:
- 10 liters of spirits;
- 20 liters of intermediate products;
- 90 liters of wine, of which 60 can be sparkling;
- 110 liters of beer;
Exceeding these quantities places the driver in the sights of the authorities, even if the intention is only to share with friends or family.
Documentation and formalities
In addition to the quantities, the transport of alcohol requires attention to the documentation. According to Article 85 of the CIEC, in commercial operations or travel involving tax warehouses, it is mandatory to present follow -up documents.
Ignoring these formalities can lead to the seizure of goods and the opening of administrative processes.
Coimas
The breach of these rules is a tax infraction pursuant to article 121 of the General Regime of Tax Infringements (RGIT).
Fines vary according to gravity and amount transported, and may reach 3,000 euros in more severe situations, namely when there is an unlavoded commercial intention or smuggling.
According to the Tax Authority, even transport that seem harmless can generate complications if they exceed legal limits or not accompanied by the required documentation.
Other sanctions
In addition to fines, there are criminal risks. The Penal Code provides for proceedings for tax fraud or smuggling, and the seizure of beverages is frequent.
Drivers can be called to make statements or respond in court. Prudence is therefore essential: Respecting the limits and having the documents in order prevents a simple trip from becoming a complex and expensive situation.
As with, the rules are clear. Following quantity limits and ensuring the correct documentation ensures that transport of beverage in the car remains safe from a legal point of view, while any excess or carelessness can quickly complicate the life of the traveling.
