Magistrate also points out that the influencer and husband ‘have adopted repeated conduct to make it difficult to clarify the truth, such as the attempt to destroy documents and electronic devices’
The digital influencer and his husband, Israel Nata Vicente-known as Euro-were arrested on Friday morning, 15, in a high standard house in Carapicuíba, in the metropolitan region of São Paulo. Both are suspected of exploring children and adolescents on social networks. The defense states that they are innocent and are available to the authorities. The arrests occurred by determination of the court of Paraíba, after a task force between the Public Prosecution Service of Paraíba, the Labor Prosecutor’s Office and the Civil Police of SP. In the decision, which the report had access, Judge Antonio Rudimacy Firmino de Sousa, from the 2nd Court of Bayeux, State of Paraíba, states that there is no doubt of the repeated practice of trafficking in persons. “No doubt there are elements that indicate repeated practice of the crime of trafficking in persons,” he says.
Based on all material collected in the investigations, the judge ordered the pre -trial detention (without a determined time), instead of the temporary. “Preventive arrest is a broad precautionary measure, and an imprisonment tool is efficient during the police phase or criminal instruction. The assumptions for their decree are proof of the existence of the crime and sufficient evidence of authorship.”
In the document, the judge also points out that “there is strong evidence of authorship and materiality” of the crimes of:
. Trafficking in people;
. Exploitation of people
. Sexual exploitation and irregular artistic child labor;
. Production of videos with dissemination in social networks, embarrassment of children and adolescents
The magistrate also points out that the influencer and husband “have adopted repeated conduct to make it difficult to clarify the truth, using illicit practices such as attempting to destroy documents and electronic apparatus, empties in hurry, hiding values and vehicles used.”
The defense of Hytalo Santos and Israel Nata Vicente reaffirms that both are innocent and “always made themselves available to the authorities.” He also says that, so far, he has not had access to the content of the decision that determined the extreme measure, which makes it impossible for a more detailed manifestation. “Once we are aware of the grounds, we will adopt all appropriate judicial measures to safeguard the rights of Hytalo and Israel Nata Vicente, including the entrance of Habeas Corpus, if necessary,” says Ueno & Kompier Abib Lawyers and Cassimiro & Galhardo Advogados.
Denounced by Felca and investigated by the Public Prosecution Service
Hytalo was the main target of Youtuber Felca in complaints about adultization. The process has been in a long time, but the pressure against Hytalo grew after complaints made against him by the digital influencer, in a video posted on August 6.
House in João Pessoa was locked
On Thursday, 14, bailiffs and military police officers went to the house of the influencer, in a gated community in João Pessoa, Paraíba, to comply with the decision, and found closed doors. In addition to the search and seizure, the court also prohibited the influence of the influencer with the minors and determined the conduct of a psychosocial study with the adolescents involved. The decision, published on Wednesday, also determined the seizure of all electronic devices (cell phones, computers, cameras, hard drives, pen drives, among others) used hytalo for the recording, editing and dissemination of digital content. “(They) should later be referred to the police authority to perform the expert analysis for the extraction of the data,” added the Court of Paraíba.
The police and bailiffs arrived at the house of the influencer, in João Pessoa, around 4:30 pm on Wednesday. They were able to access the backyard, where a washing machine was in operation, but there was no one in the property – the Military Police suspect that the court decision leaked and that the people in the house rushed before the agents arrived. According to the Military Police, representatives of the condominium reported that the influencer left the house carrying many electronic equipment, shortly before the arrival of the police and bailiffs. Their mission was precisely to apprehend cell phones, computers and other electronic equipment used in the recordings made by Hytalo.
