The virtual plenary of STF (Federal Supreme Court) resumes this Friday (15) the judgment of the federal deputy licensed Carla Zambelli (PL-SP) on illegal firearm crimes and illegal embarrassment. The court already has a majority to condemn the parliamentarian.
The case is pending in the Supreme Plenary, where all 11 ministers can vote. The trial had been suspended in March this year ,. The process is under Gilmar Mendes’s rapporteur.
In the trial, the rapporteur presented the vote to convict 5 years and 3 months in prison for crimes of illegal possession of firearms and illegal embarrassment with the use of firearm.
Gilmar was accompanied by Alexandre de Moraes, Carmen Lúcia and Flávio Dino. Even after the sight of Nunes Marques, ministers Cristiano Zanin and Dias Toffoli anticipated their votes in the same direction as the rapporteur.
The trial will resume to present the votes of Nunes Marques, André Mendonça, Luiz Fux, Edson Fachin and the president of the Court, Luis Roberto Barroso.
The deputy is accused of pursuing, with a gun in hand, a man in the middle of the street in a neighborhood of the noble area of São Paulo, in October 2022. He was supporter of the then candidate Luiz Inacio Lula da Silva (PT).
Condemnation and Extradition
If confirmed, Zambelli’s penalty will be added to the ten years in prison and loss of parliamentary mandate, decided by the first class of the Supreme Court.
Earlier this year, the deputy and hacker Walter Delgatti were convicted by the First Class of the Supreme Court for invasion of the CNJ (National Council of Justice) systems.
The conviction occurred after a complaint of the MPF (Federal Prosecutor). According to the agency, the invasion of the system in the CNJ occurred in 2023 and consisted of issuing an arrest warrant against Minister Alexandre de Moraes.
“The arrest warrant is issued to the detriment of myself, Alexandre de Moraes. Publish, submit and do L,” said an excerpt from the fake document.
But before the case was res judicata, the parliamentarian fled Brazil. His final whereabouts was in Italy. Her name was placed on Interpol’s red diffusion list and the Brazilian government found the extradition process.
The deputy was arrested on July 29 and is in the female prison of Rebibbia in Rome. In the first hearing, held on August 1, the Italian court ordered its stay in prison during the analysis of the extradition request for Brazil, but authorized the use of medicines.
