The Federal Supreme Court (STF) consolidated the rank of the coup’s criminal actions and established this Friday, 15, composed of former President Jair Bolsonaro (PL) and the other seven defendants.

The accused will begin to be tried on September 2 in the first class of the court. The forecast is that the analysis will be completed by the 12th of next month. The dates were set to avoid the risk of judgment to advance to the 2026 election year in the event of a request for a view.

The extraordinary sessions were scheduled for the 2, 3, 9, 10 and 12 September. Initially, Ministers agreed that the five Tuesdays of September would be reserved, which would take the trial until the 30th.

The dates were defined yesterday by Minister Cristiano Zanin, president of the first class, after the case was released for trial by Alexandre de Moraes, the rapporteur of the case.

The process proceedings follows an agile rhythm. The criminal action dealing with the “crucial core”-as defined by the report of the Attorney General’s Office (PGR)-was established on March 26 this year, when Bolsonaro and seven other accused of the crucial core saw defendants.

The Attorney General, Paulo Gonet, defends the conviction of the seven defendants for all the crimes listed in the complaint-attempted violent abolition of the Democratic Rule of Law, coup, armed criminal organization, damage qualified by violence and severe threat and deterioration of overturned assets.

The collegiate also comprises the ministers Flávio Dino, Luiz Fux and Cármen Lúcia.

Special operation

The decision of the collegiate to set up a special operation for the trial, with additional and consecutive sessions throughout September, repeats what occurred when receiving the complaint. Normally, STF classes meet biweekly, but the schedule can be alternated depending on the agenda. On all dates, the sessions will be held from 9am to 12pm. On days 2, 9 and 12 there will also be sessions from 14h to 19h. New sessions can be scheduled if the trial is not completed by the reserved final date.

The defendants ended up sending the last arguments on Wednesday. The defenses called for acquittal for procedural reasons and lack of evidence. With this, the so -called “instructional phase” of the process was completed, paving the way for judgment. During the instruction, witnesses and defendants were heard, including in trading to confront their versions.

Defenses

Between qualifying the accusation as “absurd”, minimizing participation in the coup plot and even stating that it acted against the conspiracy, all defendants in the so -called “crucial nucleus” that respond to the criminal action of the coup requested acquittal in the case for procedural reasons and lack of evidence. Bolsonaro, appointed by the PGR as leader of the criminal organization, is accused of five crimes that, added, can yield 43 years in prison, if the maximum penalties and aggravating features of each of them.

The former president’s lawyers called “absurd” the complaint and ask for his acquittal on the grounds that there is no evidence, including to attach it to the coup act of 8 and the “green and yellow dagger” plan, which provided for the murder of Brazilian authorities. In the end, they also require the trial to be impartial.

The defense says the process is “as historical as it is unusual” and describes a picture in which Bolsonaro is the victim of a press “massacre”, making it implicit that he would be the victim of prior trial by the media.
