The federal government is expected to meet later this week with representatives in Brazil of Goal, owner of Facebook, Instagram and WhatsApp, Google and Tiktok, to present the text on social networks regulation.
According to CNN, the meeting will be attended by members of the Ministry of Justice and the Presidency Secretariat of Communication. The assessment is that the meeting with the Big Techs expands the discussions. The government wants to send Congress a more “round” text as possible.
The idea of the meeting is to give knowledge to the proposal to companies before sending the project to the National Congress next week. The text has been prepared by technicians from MJ and Secom, and has been in the Civil House for two months.
Over the past week, President Luiz Inacio Lula da Silva (PT) conducted a series of
What the text says
The federal government works to complete the text of one and technology companies. The draft discussion provides for the withdrawal of contents considered illegal without the need for court decision and the possibility of temporary suspension of platforms.
The proposal provides that the ANPD (National Authority of Data Protection), a body linked to the Ministry of Justice and Public Security, could act for the withdrawal of content and publications, the measure targets posts related to crimes such as racism, child sexual exploitation, incitement to suicide and attacks on the democratic rule of law.
By the text, companies that fail to comply with determinations may be suspended for a certain period.
The project also establishes fines, warnings and the obligation that platforms maintain legal representation in the country, to facilitate contact with Brazilian authorities and users.
Economic competition
In addition to this proposal, the government should also send Congress a second text related to the subject, which expands the antitrust power of Cade (Administrative Council for Economic Defense) against the Big Techs.
Formulated by the Ministry of Finance, the text is inspired by the United Kingdom Digital Markets Law, which entered into last year.
The text allows CADE to anticipate any anti-confidential conduct of technology companies previously classified as “systemic relevance” in their respective markets.
One of the most important points of the project is the creation of a specific superintendence in Cade with powers to apply special obligations to Big Techs.
By current legislation, processes in the antitrust agency are considered too slow to track the speed of the sector.
