The Superior Court of Bogotá has failed on Tuesday afternoon a guardianship in favor of the former president. The sentence, which protects its fundamental rights and is different from the criminal process that it faces, orders immediate freedom for the ex -president and revokes house arrest until the Court itself defines in the second instance its case. The decision is given two weeks after Judge Sandra Heredia, and ordered the house prison immediately.

“Leave without effect the quarter of the ruling issued on August 1, 2025, by the 44th Criminal Court of the Circuit of Bogotá, as soon as ordered the immediate deprivation of the liberty of the citizen Álvaro Uribe Vélez; until the corresponding Criminal Decision Chamber, of this Court defines the appeal filed against that determination of first instance. of freedom in favor of the tutelante ”, reads in this Tuesday’s decision.

The decision, signed by magistrates Leonel Rogeles Moreno and Aura Alexandra Rosero, does not refer to the fund of the conviction, in the way in which the judge validated and valued the evidence or the criminal responsibility of the former president. It refers to Uribe has the right to wait for the final decision of the appeal in freedom. The Court’s decision explains that the criteria used by the judge to justify the arrest, when there was an appeal, were “vague, indeterminate and inaccurate.” The ruling concludes: “It is unintelligible why this deprivation of liberty is necessary for peaceful coexistence and social order.”

According to the signatory magistrates, in this case the restriction of freedom to former President Uribe is “disproportionate as soon as the presumption of innocence prevails until the conviction decision copper execution.” To do this, they recalled that a judgment of the Constitutional Court of 2024 made it clear that the arrest when there is a judgment of first instance is exceptional and must be motivated very precisely by the judges, and found that this did not happen in the case of Uribe. “The argument that the immediate house prison is adequate to redeem the penalty and proportional to the damage caused in which the protection of the legal order and citizen confidence on individual freedom should prevail, they equate that measure to an early sanction when lacking additional and duly founded criteria that support it,” reads the text of 38 pages, and that it is an answer not only to the action of the action filed by Uribe. To three others who essentially alleged the same. One of them was signed by Gabriel Vallejo, director of the Democratic Center Party, which Uribe created and of which he is a life president.

Vallejo has been one of the first figures to react to the decision. “It is great news for the country, for the Democratic Center Party, but especially for former president Álvaro Uribe who will continue to defend himself,” he celebrated. The American senator of origin Bernie Moreno, of the Republican Party and who was gathered with the former president just four days ago, joined the voices of joy: “Great news from Colombia. A high court in Bogotá ordered the immediate release of former president Uribe. Democracy thrives when a country has solid institutions. This decision of today is a victory for both Colombia and for the Uribe family.”
