Minister Alexandre de Moraes of the Federal Supreme Court (STF) gave a period of 48 hours for the defense of Jair Bolsonaro (PL) to explain the breach of precautionary measures imposed by the Court and the existence of evidence of an Argentine escape plan, revealed by the Federal Police.
The determination occurs on the same day that the PF indicted Bolsonaro and Deputy Eduardo Bolsonaro (PL-SP) for attempted obstruction of the criminal action that investigates the scammer articulation of 2022. The two are accused of coercion in the course of the process and attempted violent abolition of the democratic rule of law.
According to Moraes, the PF final report points out that Bolsonaro reiterated criminal practices even after the measures imposed by the Supreme Court. The investigation identified several violations, including the continuous use of social networks to spread messages – which was prohibited – and the maintenance of contact with other investigators, which also infringes court decisions.

“During the investigation and with the restoration of saved data through backup, the Federal Police checked Jair Bolsonaro’s intense activity in the production and spread of messages for social networks, in clear affront to the previously imposed precautionary measure,” Moraes wrote in the decision.
The PF also detailed that the former president has adopted methods to circumvent restrictions, such as changing mobile devices and sending messages to transmission lists on WhatsApp, involving allies and parliamentarians. Bolsonaro would also have appealed to foreign lawyers to produce directed content against the Federal Supreme Court.
Another point that caught the researchers’ attention was the discovery of a text file, except on Bolsonaro’s cell phone, with a sketch of political asylum to Argentine President Javier Milei.

The document, according to the PF, was created by a profile linked to Fernanda Bolsonaro, wife of Senator Flávio Bolsonaro (PL-RJ), and said that the former president was “persecuted for reasons and essentially political offenses.”
“Based on such legal diplomas, I submit this request, requesting the granting of political asylum to me, Jair Messias Bolsonaro,” says the excerpt from the text, dated 10 February 2024.
